VAUGHT LAW FIRM
What Does Family Law Cover?
Family law covers a wide range of cases. These include divorce, custody, prenuptial and postnuptial agreements, child support and family law appeals. Also, within these cases, there are various ways to go through the process, like traditional litigation, negotiation, kitchen table litigation, mediation, collaborative litigation, and arbitration. The Vaught Law Firm is able to offer our clients all of these methods of resolving family law issues with high-quality, reliable and trusted advice.
Divorces range from simple to complex. Factors that make a divorce complex include credit card debt, unpaid tax liabilities, real estate, investments, retirement, closely-held businesses, special needs children, separate property claims, untreated addiction and mental health issues, and CPS investigations. We are not a “cookie-cutter” firm. Our approach to each case is client-driven. Our client is an important partner in our case, and we bring our firm’s resources to your case to obtain the best possible result.
Family Law Mediation
Our firm nearly always goes to mediation prior to a trial. In mediation, you have time to negotiate your case with the help of a third-party mediator, and to choose which terms you can or cannot agree to. Jimmy Vaught, Erin Leake, and Jillian French are all experienced in negotiating mediated settlement agreements. Additionally, Jimmy Vaught as a trained mediator, has the experience to mediate for other attorneys with their clients.
Family Law Appeals
If you receive an unfavorable ruling from a Texas court, we can help you appeal the decision. We can evaluate your case and talk with you about the cost of an appeal. Jimmy Vaught is an experienced attorney and is one of the few attorneys in Texas that are Board Certified in Family Law and Civil Appellate Law by the Texas Board of Legal Specialization.
For some couples or parents, collaborative law is an alternative to traditional litigation that is held outside of the courts. The parties and their attorneys meet in a series of working conferences to work towards a resolution of the issues.
Arbitration is a method where the issues are presented to a third-party arbitrator, and the arbitrator will make a final, binding decision. Generally, arbitration is used in the family law arena to resolve disputes arising after an agreement has been reached, either by mediation or trial.
Prenups are very flexible and ours are tailored to our clients’ specific concerns. Jimmy Vaught has the experience necessary in preparing, upholding, and breaking prenuptial agreements.
A prenuptial agreement can separate the financial portion of the couple’s relationship and leave intact the marital portion. Jimmy Vaught has prepared many postnuptial agreements and often works with estate planning attorneys.
Same-sex and transgender couples face additional hurdles with regard to how they choose to add children to their families and we understand the current law. At the Vaught Law Firm, we are committed to making our clients feel respected and well-served without regard to race, nationality, gender or sexual orientation.
Some fathers, upon the breakup of the family unit, may face having less time with their children than they would like. We want all parents to have meaningful relationships with their children and will work for our clients to obtain the best custody arrangement.
Custody issues can arise as a result of a divorce but can also happen between parents who have children but are not now or have never married each other. At the time of the divorce, custody of any minor children of the marriage is part of the final orders from the divorce.
Often after a divorce, one parent needs to relocate with the children. In Texas, a parent’s ability to relocate with a child is often dependent upon the child custody agreement that was established following his or her divorce. Therefore, it is crucial to have an experienced child custody advocate on your side should you need to relocate.
Kitchen Table Litigation
Some couples are able to work out agreements while working closely with their attorneys without going through a lot of the formal processes. We are ready to talk with you about your case and recommend the most appropriate method for your case.
What to Expect in Texas Family Law Court?
A trip to the courthouse is something that most people have never experienced. They have seen it in movies and TV shows, but those are not totally accurate. Family law is within the jurisdiction of District Courts in each county. The county where you or the children reside is usually the appropriate court.
Prior to any court appearance, our attorneys in Austin, TX will work with you on what to expect in the courtroom, what to wear, and how to behave in court and how to answer questions during testimony.
